Terms & Conditions

These Terms govern your relationship with the operator of the Madnix service made available through the website madnix-aussie.com ("Site"). By accessing or using the Site or creating an account, you agree to be bound by these Terms and all policies referenced in them. If you do not agree, you must not use the Site. These Terms are effective from 1 January 2026 and replace all previous versions for Australian-targeted users.

Definitions

For the purposes of these Terms, the following definitions apply:

  • Operator means The Luck Factory B.V., a private limited liability company (B.V.) incorporated in Curaçao and operating from Kaya Richard J. Beaujon Z/N, Curaçao, which operates the Madnix brand for the regional website madnix-aussie.com.
  • Madnix means the online gambling brand "Madnix" as offered through madnix-aussie.com for users located in or accessing from Australia.
  • Madnix means the specific regional implementation and review-facing service of the Madnix brand as presented on and through madnix-aussie.com.
  • Site means the website located at https://madnix-aussie.com and any sub-pages, sub-domains, mobile or associated interfaces operated by or on behalf of the Operator in connection with the Madnix brand.
  • Account means a personal account opened and maintained by a User on the Site for the purpose of participating in games, placing Bets, receiving Bonuses and managing funds.
  • User or Player means any natural person who accesses the Site, registers an Account or otherwise uses the gambling services provided through the Site.
  • Games means any casino games, slots, live casino games, table games, instant win games or other gambling products offered on the Site from time to time.
  • Bet or Wager means any amount of real money or Bonus funds staked by a Player on the outcome of a Game or event offered on the Site.

Account Registration

Eligibility and Age Verification

  • Age requirement: You may only register and hold an Account if you are at least 18 years old, or older if the law in your country of residence requires a higher minimum age for online gambling. The Site and the Madnix service are intended solely for adults.
  • Jurisdictional responsibility: The Operator is licensed in Curaçao under reference 1668/JAZ issued by Curaçao eGaming.   2. Email verification: You may be required to confirm your email address by clicking a verification link sent to you. Failure to complete email verification may restrict or block access to your Account and to the Madnix features.
  3. KYC documents: At registration and at any time thereafter, you may be required to provide KYC documents, which may include:
    • Government-issued photo ID (passport, national ID card, driver's licence);
    • Proof of address (utility bill, bank statement or similar document issued within the last three months);
    • Proof of ownership of payment methods used (e.g. card statement with masked digits, e-wallet screenshot);
    • Source of funds or source of wealth documents where considered necessary to comply with anti-money laundering (AML) and counter-terrorist financing (CTF) obligations.
  4. Verification checks: The Operator may use third-party verification providers and databases to confirm your identity, age and address. If your identity cannot be reasonably verified, your Account may be suspended, and any Bets voided at the Operator's discretion, subject to applicable law.

User Obligations

  • Accuracy of data: You must ensure that all Account information (including email, address and payment details) remains true, accurate and current. You must promptly update any changes via your Account settings or by contacting [email protected].
  • Password security: You are solely responsible for maintaining the confidentiality of your login credentials. You must:
    • Keep your username and password secret;
    • Not share or transfer your Account to any third party;
    • Notify the Operator immediately if you suspect any unauthorised access or security breach.
  • Personal use: Accounts are for personal, non-commercial use only. You must not use the Site on behalf of another person or as part of any group, pool or syndicate, unless explicitly permitted in writing.
  • Prohibition of fraud: You must not engage in any fraudulent, collusive, money-laundering or other unlawful conduct. The Operator may report suspected offences to relevant authorities in Curaçao, Australia or elsewhere in accordance with legal obligations.

Betting & Gameplay Rules

General Rules for Bets and Games

  • Game rules: Each Game offered on madnix-aussie.com is subject to its own specific rules and payout tables, which are accessible within the Game interface or on dedicated information pages. By placing a Bet, you acknowledge and accept the relevant Game rules.
  • Minimum and maximum Bets: Minimum and maximum stakes are determined per Game or table and displayed within the Game interface. The Operator may change these limits at any time for technical, legal or risk-management reasons.
  • Bet acceptance: A Bet is considered accepted once it has been processed by the Operator's servers and appears in your Game history or transaction log. If a Bet is not recorded on the Operator's systems, it shall be deemed not to have been placed, even if funds appear to have been deducted from your Account.
  • Use of Real Money and Bonuses: Where applicable, Bets may be placed using your Real Money Balance, your Bonus Balance, or a combination thereof, consistent with the Site's wallet structure and Bonus terms. Real money is typically used before Bonus funds, unless otherwise stated.

Cancellation and Modification of Bets

  • Player-initiated changes: Once a Bet has been accepted, you may not cancel or modify it, except where the specific Game's interface expressly allows you to cancel or change a Bet before final confirmation.
  • Operator corrections: The Operator reserves the right to void or adjust Bets and results in the following circumstances:
    • Obvious technical errors (e.g. system malfunction, misconfiguration, incorrect odds or pay tables);
    • Games affected by network interruptions, server failures, or software glitches resulting in an incorrect display or settlement;
    • Suspicion that the Bet was placed in breach of these Terms, including collusion, bot use, exploitation of bugs or other fraudulent behaviour.
  • Malfunction clause: In the event of a malfunction of the gaming hardware or software, all affected Bets and winnings may be declared void. Bets will generally be refunded to the Real Money Balance, and any associated winnings will be removed, subject to applicable law and game-provider rules.

Live Casino, Chats and Player Conduct

  • Respectful behaviour: When using live casino games, chat features or any interactive functions on madnix-aussie.com, you must behave respectfully towards dealers, staff and other Players. The following conduct is strictly prohibited:
    • Insults, threats, harassment or hate speech;
    • Use of obscene, pornographic, extremist or discriminatory language or content;
    • Promotion of illegal services, drugs, or other websites.
  • Prohibition of cheating tools: You must not use software bots, automated systems, scripts, coordinated group strategies, or any device intended to gain an unfair advantage. Card counting or similar advantage play may lead to restrictions or exclusion from specific Games.
  • Chat moderation: The Operator and its service providers may monitor and moderate chat in real time. Messages may be removed, and chat privileges suspended or revoked without notice for violations of these rules.
  • Consequences of misconduct: Breach of conduct rules may result in:
    • Warning messages;
    • Temporary or permanent exclusion from chats or specific Games;
    • Suspension or closure of your Account, with potential forfeiture of Bonuses and winnings derived from prohibited behaviour.

Bonus Terms

General Bonus Conditions

  • Discretionary nature: Bonuses, free spins, cashback and similar promotions offered on madnix-aussie.com in connection with Madnix are discretionary and may be granted, modified or withdrawn by the Operator at any time, in accordance with applicable law.
  • Bonus-specific rules: Each Bonus or promotion is subject to specific terms communicated on the relevant promotion page, email or within your Account interface. In the event of a conflict, the specific Bonus rules prevail over this general section.
  • Eligibility: The Operator may limit certain promotions to specific user groups, jurisdictions, currencies, devices or time periods. Australian-located Players are subject to these Terms but may also be affected by Australian laws restricting marketing or offering of certain gambling services.

Activation, Wagering and Timeframes

  • Activation: A Bonus may require:
    • Entry of a promo code;
    • Opt-in via a promotion window or email link;
    • Making a qualifying deposit or Bet within a defined period.
  • Wagering requirements: Unless otherwise stated, Bonus funds and associated winnings are subject to wagering requirements before they can be withdrawn. For example, a 35x wagering requirement on a AU$100 Bonus requires AU$3,500 in qualifying Bets before withdrawal of the Bonus and related winnings is permitted.   • Irregular play: The following behaviours may be considered abusive or irregular bonus play:

  • Combining promotions: Unless explicitly allowed, multiple Bonuses or promotions cannot be active or combined at the same time. You may be required to complete or forfeit the currently active Bonus before claiming a new one.
  • Consequences of abuse: In case of suspected Bonus abuse, the Operator may:
    • Remove the Bonus and associated winnings from your Account;
    • Refund only the original deposit amount to your Real Money Balance, where appropriate;
    • Restrict your eligibility for future promotions or close your Account in serious or repeated cases.

Payments & Withdrawals

Deposits

  • Payment methods: The Operator may make available various deposit methods, which can include:
    • Credit and debit cards issued by major schemes (where allowed by the issuer and local law);
    • E-wallets and online payment services;
    • Bank transfers;
    • Cryptocurrencies or other digital assets, subject to additional conditions and market availability.
    The availability of particular methods to Australian-located Players may be restricted by payment providers, banks or regulators.
  • Ownership of payment instruments: You may only use payment methods that are registered in your own name. The Operator may request documentation evidencing such ownership.
  • Deposit limits: Minimum and maximum deposit amounts apply per transaction and/or per day, as displayed in the cashier section. The Operator may adjust these limits for risk, legal or technical reasons.
  • Fees and currency conversion: The Operator aims not to charge deposit fees; however, fees may be imposed by your bank, card issuer, wallet provider or currency exchange services. Withdrawals

  • Verification requirement: Before processing any withdrawal, the Operator may require you to complete KYC verification and, where necessary, provide additional documents, including proof of payment source and source of funds.
  • Withdrawal methods: Withdrawals will generally be processed to the same payment method used for deposits, where possible. If this is not technically or legally feasible, an alternative method may be offered, subject to additional checks.
  • Processing times: The Operator endeavours to review and process withdrawal requests within a reasonable timeframe, typically within 1 - 5 Business Days after all required verifications have been completed. Actual receipt of funds depends on third-party payment providers and may take longer.
  • Withdrawal limits: Minimum and maximum withdrawal limits apply per transaction and/or per period (e.g. daily, weekly or monthly). Such limits will be displayed in the cashier or communicated by support.
  • Fees: The Operator may charge reasonable withdrawal or administrative fees in specific cases (e.g. repeated withdrawals without gameplay, currency conversions). Any such fees will be disclosed before confirming your withdrawal.

Refunds, Reversals and Treatment of Bets and Bonuses

  • Deposits and refunds: Deposits are not intended to be used for currency exchange or money transfer purposes. The Operator is generally not obliged to refund deposits once used for gambling. Refund requests (for example, in cases of technical error) will be reviewed individually and may require additional documentation.

Limitation of Liability

Operator's Obligations and Fairness

  • Provision of services: The Operator undertakes to provide the Site and the Games with reasonable skill and care and to operate under its Curaçao eGaming licence (reference 1668/JAZ) as at least assumed active through 2026 according to the latest verification note, subject always to regulatory and technical constraints.

Exclusions and Limitations

  • No liability for indirect loss: To the maximum extent permitted by applicable law, the Operator is not liable for:
    • Any indirect, incidental, consequential or special damages (including loss of profits, revenue, business, data or goodwill);
    • Losses arising from your failure to comply with these Terms or with local legal requirements in your jurisdiction (including Australian laws restricting offshore gambling services);
    • Actions or omissions of third-party service providers, including payment processors, telecommunications companies or game providers.
  • Technical failures and interruptions: The Operator is not liable for:
    • Network interruptions, delays, packet loss, or internet outages;
    • Hardware or software failures on your device;
    • Service interruptions or domain blocking ordered or implemented by authorities or ISPs (including blocking actions initiated by ACMA under the IGA).
  • Maximum compensation: Where the Operator is found liable to you under applicable law, its maximum aggregate liability shall not exceed:
    • The amount of the relevant Bet in relation to which the liability arose; or
    • Where the claim does not relate to a specific Bet, the lower of (i) the net amount of deposits made by you on the Site during the three (3) months preceding the incident, and (ii) AU$5,000 (or equivalent), unless mandatory law requires a higher limit.
  • No exclusion of mandatory rights: Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any statutory rights that may apply to consumers.

Intellectual Property Rights

Ownership of Content and Software

  • Proprietary rights: All intellectual property rights in and to the Site (madnix-aussie.com), the Madnix brand, the Madnix implementation, the software, databases, graphics, text, logos, trademarks, audio and video material, and other content are owned by the Operator or its licensors and are protected by copyright, trademark and other intellectual property laws.
  • Limited licence: Subject to your compliance with these Terms, the Operator grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site and Games for personal, non-commercial entertainment purposes only.

Restrictions on Use

  • Prohibited acts: Without the prior written consent of the Operator, you must not:
    • Copy, reproduce, distribute, transmit, publish, display, perform, modify, create derivative works from or otherwise exploit any part of the Site or its content;

  • Notification of changes: Where changes are material, the Operator will use reasonable efforts to notify you through one or more of the following:

Termination & Suspension

Operator's Right to Suspend or Close Accounts

  • Grounds for suspension/closure: The Operator may suspend or terminate your Account, and/or restrict your access to madnix-aussie.com and the Madnix service, in whole or in part, at its reasonable discretion, including where:
    • You breach any provision of these Terms or other policies;
    • You provide false, misleading or incomplete information during registration or verification;
    • There is suspicion of fraud, money-laundering, terrorist financing, collusion or other criminal activity;
    • You reside in, or access the Site from, a Restricted Jurisdiction or any country in which the Operator decides to cease offering services;
    • The Operator is required to do so by law, by a court, or by a regulatory or governmental authority (including ACMA's enforcement actions).
  • Temporary measures: Pending investigation of potential breaches, the Operator may place temporary limitations on your Account, including suspension of withdrawals, cancellation of Bonuses or blocking access to specific Games.

Consequences and Refund of Funds

  • Balance on closure: Upon termination by the Operator for reasons other than serious breach, the remaining Real Money Balance (excluding Bonuses and Bonus winnings) will, where legally and technically feasible, be paid out to you, subject to standard withdrawal and verification procedures.

Governing Law & Jurisdiction

Nothing in this clause limits any rights you may have under mandatory consumer protection laws that provide for the jurisdiction of your local courts.
